The information provided by the Client/ Agent at the time of the conclusion of the Subscription Agreement shall be processed electronically in Previsite’s data files. In accordance with law No. 78-17 of 6 January 1978, known as the “Information Processing and Liberties law”, the Client shall have a right of access and rectification of the data concerning him with Previsite’s commercial department, and may object to this personal information being processed or transmitted to third parties by indicating it expressly to Previsite.

OWNERSHIP

PREVISITE Web 2.0 Solution made available to the Client/ Agent and online viewer by Previsite within the services provided by the Company remains the exclusive property of Previsite. Any reproduction or distribution of any one of PREVISITE Software products including the unlocking keys, without a written consent by PREVISITE is strictly forbidden and the client/ Agent or Online viewer will be held responsible towards of Previsite for any breach of it’s right of property.

The Client authorises Previsite to proceed with all necessary modifications and adaptations on PREVISITE web 2.0 SOlution in the perspective of it’s development, as well as all modifications related to a possible evolution of it’s graphic charter and/or the surfing toolbar of PREVISITE Web 2.0 Solution.

Previsite shall remain the sole owner of PREVISITE Software and of all the intellectual property rights related thereto.

Previsite shall also remain the sole owner of its database and the Images that are or will be contained therein.

Previsite shall not be held responsible for any images or files posted on Previsite Software by the Client and in case of any breach to the rights of intellectual property.

The client will be held responsible for all the property right linked to the transferred files to PREVISITE Software. The Lens PREVISITE Professional Lens 180 is not the property of the Client but remains the property of PREVISITE.

GOVERNING LAW - DISPUTE RESOLUTION

The Subscription Agreement shall be governed by and construed in accordance with French law.

In the absence of an amicable agreement, any dispute in connection with the Subscription Agreement shall be submitted to the exclusive jurisdiction of the competent courts in the territorial jurisdiction of the Paris Court of Appeal, including in the event of summary proceedings, an incidental claim, the presence of several defendants or impleading actions.
